Tax Residency Certificate for Exchanges: What It Is and How to Obtain It
If you operate with foreign exchanges (Coinbase, Kraken, Bitfinex, etc.) or DeFi platforms that distribute rewards from jurisdictions with withholding at source, the tax residency certificate is a document that can help you avoid being taxed twice on the same income.
What Is the Purpose of the Tax Residency Certificate?
The certificate confirms that you are a tax resident in Spain to a foreign tax authority or financial entity. It serves to:

Avoid double withholding: Some exchanges based in the U.S. (under the W-8BEN system) withhold 30% at source on certain income paid to non-U.S. residents. With the Spanish tax residency certificate + W-8BEN form, this withholding is reduced to the rate specified in the Spain-U.S. tax treaty (generally 0% for capital income not classified as dividends).

Claim IRS exemption: If Coinbase or a U.S.-based exchange asks you to prove that you are not a U.S. person (FATCA compliance), the Spanish tax residency certificate helps.

For exchanges based in countries with a Double Taxation Agreement (DTA) with Spain: If an exchange based in Ireland, Luxembourg, or the U.S. withholds taxes at source, you can claim a reduction or exemption based on the DTA, and the certificate serves as proof.

How to Obtain the Tax Residency Certificate from the AEAT
Online Process (Faster)
- Access the AEAT Electronic Office: sede.agenciatributaria.gob.es.
- Log in using a digital certificate, Cl@ve PIN, or electronic DNI.
- Select: Procedures → Declarations → Tax Certificates → Request for Tax Residency Certificate.
- Indicate the destination country (the tax authority to which the certificate is addressed).
- Select the tax year to which the certificate refers.
- The AEAT issues the certificate within 1-5 business days (usually sooner).
- Download it in electronically signed PDF format.
Requirements
- Be up to date with tax obligations.
- Be an actual tax resident in Spain (IRPF filed or in process).
- Have no outstanding tax debts.
Versions of the Certificate
- With treaty: For countries with which Spain has a DTA, a certificate specifying the applicable treaty articles is issued.
- Without treaty: For countries without a DTA, the certificate confirms residency but without referencing a treaty.
The W-8BEN Form (For U.S. Exchanges)
If a U.S. exchange (Coinbase, Kraken) requests the W-8BEN:
- Complete the W-8BEN form (available on irs.gov) indicating Spain as your country of residence.
- Attach the tax residency certificate from the AEAT.
- Specify the applicable article of the Spain-U.S. Tax Treaty (generally Article 11 for interest: rate 0-10%).
- Submit it to the exchange.
The W-8BEN is valid for 3 years; the tax residency certificate expires annually → you will need to renew it.
The Certificate and Form 720
For Form 720 (declaration of assets abroad), the tax residency certificate is not a document that must be attached, but:
- It officially confirms your Spanish residency.
- In case of a dispute about whether you are required to file Form 720, the certificate serves as proof of residency.
